This Policy applies to any user accessing the Properties, including Authorized Users of paid subscribers, free community members, website visitors, and API consumers.
Evolution Global reserves the right to investigate any actual or suspected violation of this Policy. Violations may result in immediate suspension or termination of access, content removal, reporting to law enforcement or regulators, and pursuit of injunctive or other legal relief. Evolution Global's right to suspend or terminate access applies even if a breach is unintentional, if Evolution Global believes action is necessary to protect the safety, privacy, security, or property of Evolution Global, its customers, or third parties.
If you become aware of any violation of this Policy, notify Evolution Global immediately at [email protected] and provide reasonable assistance to stop or remedy the violation.
Evolution Global products are professional tools for legitimate insurance claims management. The integrity of every claim record is foundational to the interests of policyholders, carriers, and the insurance industry as a whole.
You may not use any Evolution Global Property to engage in any form of claim data manipulation, including practices commonly known as "the scrub." Specifically, you are prohibited from:
ELIAS AI is built to the Ark Alliance Certified Integrity Standard (CIS), which requires that all AI-assisted outputs be traceable, human-reviewed, and hashed to an immutable Golden Record. Use of ELIAS AI in a manner that circumvents, bypasses, or undermines the CIS integrity framework is a violation of this Policy.
In addition to the claims data integrity prohibitions in Section 3, you may not use ELIAS AI for any of the following:
Access to Evolution Global APIs and integration endpoints is subject to the FileTrac API Access Agreement and any applicable SOW, in addition to this Policy. You may not:

Submission of false professional credentials may constitute fraud under applicable law and will result in immediate termination and referral to applicable regulatory authorities.

When using Evolution Global's third-party integrations (including XactAnalysis/Verisk, Symbility, and HOVER), you must comply with the terms of your own agreements with those third parties, in addition to this Policy. You may not:
XactAnalysis integration is available only to Mutual Customers who have executed independent agreements with both Evolution Global and Verisk/Xactware. Use of the XactAnalysis integration without a valid Verisk agreement is a violation of this Policy and the MSA.
You may not use any Evolution Global Property in any manner that infringes, dilutes, misappropriates, or otherwise violates any intellectual property or proprietary rights of others, including copyrights, patents, trademarks, and trade secrets. This includes reproducing or distributing Evolution Global Content without authorization, using Evolution Global marks without written consent, and uploading content that infringes third-party intellectual property rights.
You may not use any Evolution Global Property to transmit, store, display, distribute, or otherwise make available:
You may not frame or mirror any Evolution Global Property without prior written consent. You may not use any robot, spider, crawler, or automated tool to retrieve, scrape, or data-mine content from the Properties, systematically download claim or policyholder data outside of authorized API access, or circumvent access controls or navigational structure. Operators of public search engines have limited permission to index publicly accessible portions of evolution.global, subject to Evolution Global's right to revoke this permission at any time.
You may not use any Evolution Global Property to transmit unsolicited bulk email, spam, or messages intended to harass. You may not continue sending messages to recipients who have opted out. You may not engage in spoofing, phishing, or impersonation of any sender.
You may not use any Evolution Global Property to violate the security or integrity of any network, computer, communications system, software, or computing device. Prohibited conduct includes:
You may not use any Evolution Global Property to violate the privacy or confidentiality of others, including transmitting or making available others' private information without authorization. This includes personal information associated with accounts, policyholder or claimant information outside authorized claims management activities, and information subject to confidentiality obligations under law or contract.
You may not use any Evolution Global Property for any illegal purpose or in violation of applicable laws, including:
You may not use any Evolution Global Property in any situation where failure or fault of the Property could lead to death or serious bodily injury of any person, or to significant physical or environmental damage. This includes use in connection with aircraft or mass transportation, nuclear or chemical facilities, or safety-critical emergency response systems.
You are responsible for violations of this Policy by anyone using the Properties with your permission or using your account. Your use of the Properties to assist another person in an activity that would violate this Policy is itself a violation. Organizations subscribing to Evolution Global services are responsible for ensuring all Authorized Users understand and comply with this Policy.

Evolution Global will acknowledge all reports within two (2) Business Days and investigate all credible reports. You agree to provide reasonable cooperation in any investigation.
Evolution Global may modify this Policy at any time by posting a revised version at evolution.global/legal/acceptable-use. Material changes will be communicated with at least 14 days' advance notice via email or in-platform notification. Continued use of any Evolution Global Property following the effective date of any revision constitutes acceptance of the revised Policy, to the extent permitted by applicable law. Prior versions are archived and accessible at evolution.global/legal/acceptable-use.
In addition to the general acceptable use provisions above, all Evolution Global personnel — including employees, contractors, and temporary staff — must comply with the following requirements when using company-owned or company-managed technology assets. For purposes of this section, "Company Assets" means all computing devices, software, networks, cloud services, communication tools, and data storage systems owned, licensed, managed, or provided by Evolution Global, Inc.
All Company Assets remain the property of Evolution Global. Evolution Global reserves the right to monitor, access, review, and audit all activity on Company Assets at any time, without prior notice, to the extent permitted by applicable law. Personnel should have no expectation of privacy when using Company Assets.
Company Assets are provided primarily for business use. Limited personal use is permitted provided it does not interfere with job performance, consume excessive resources, violate any provision of this Policy, or expose Evolution Global to legal or security risk.

All personnel must complete security awareness training within 30 days of hire and annually thereafter. Training covers phishing identification, social engineering, data classification, incident reporting, and secure handling of customer data. Personnel who fail to complete required training within the designated period may have system access suspended until training is completed.
Violations of this section by Evolution Global personnel may result in disciplinary action up to and including termination of employment, in addition to any legal remedies available. All personnel are required to acknowledge this Policy annually and upon any material update.

This Acceptable Use Policy (this "Policy") describes prohibited uses of the hosted application and infrastructure service as well as other services (the "Service") offered by Evolution Global, Inc. ("Evolution Global") and the related website located at ftevolve.com (the "Site"). This policy supplements, and is incorporated into, Evolution Global's Master Subscription Agreement and the Terms of Use for the Site. If any provision in this Policy conflicts with a term in the MSA or the Terms of Use, then the applicable provisions of the MSA and the Terms of Use will prevail unless the term in this Policy specifically states that it will prevail.
If you violate this Policy, Evolution Global may suspend or terminate your use of the Service or access to the Site. Evolution Global's right to suspend or terminate your use of the Service or Site applies even if a breach is committed unintentionally or without your authorization if Evolution Global believes that suspension or termination is necessary to ensure compliance with laws or to protect the rights, safety, privacy, security or property of Evolution Global, its customers or third parties.
Evolution Global may modify this Policy at any time by posting a revised version on the Site. By using the Service or accessing the Site, you agree to the latest version of this Policy.
You may not use the Service or Site in any manner that would result in an infringement, dilution, misappropriation or other violation any intellectual property or proprietary rights of others, including but not limited to copyrights and rights arising from patents, trademarks and trade secrets.
You are solely responsible for any content published or made available by you through the Service or Site. You may not use the Service or Site to transmit, store, display, distribute or otherwise make available content that is defamatory, libelous, threatening, harassing, abusive, hateful, deceptive, fraudulent, obscene, pornographic, indecent, harmful to minors, or otherwise objectionable, including without limitation content that constitutes child pornography.
You may not use the Service or Site to transmit, store, display, distribute or otherwise make available content or technology that may damage, interfere with, surreptitiously intercept, or expropriate any system, program or data, including without limitation viruses, Trojan horses, bots, worms, scripting exploits, time bombs or other malicious code.
You may not frame or mirror the Site without Evolution Global's express prior written consent. You may not use any robot, spider, site search/retrieval application or other manual or automatic device to retrieve, index, "scrape", "data mine", or in any way gather any messages, text, files, images, photos, video, sounds, profiles, works of authorship, or any other content from the Service or Site or reproduce or circumvent the navigational structure or presentation of the Service or Site without Evolution Global's express prior written consent. Notwithstanding the foregoing, Evolution Global grants to the operators of public search engines the permission to use spiders to copy material from the Site for the sole purpose of creating publicly available searchable indices of such material. Evolution Global reserves the right to revoke these exceptions either generally or in specific cases.
You may not use the Service or Site to transmit unsolicited email or other messages, including without limitation unsolicited bulk email ("spam"), or email or messages that are excessive and/or intended to harass or annoy others. You may not continue to send email or other messages to a recipient who has indicated that he/she does not wish to receive them. You may not alter or obscure email or message headers or assume a sender's identity (including without limitation by engaging "spoofing", "phishing", or similar attacks) without the sender's explicit permission.
You may not use the Service or Site to violate the security or integrity of any network, computer or communications system, software application or computing device (each, a "System"), including without limitation by attempting to: (a) probe, scan or test the vulnerability of a System or breach or circumvent security or authentication measures without authorization; (b) make network connections to, or otherwise access, a System without authorization; (c) monitor data or traffic on a System without authorization; (d) tamper, reverse-engineer, hack, interfere with, disrupt or disable a System, including without limitation by means of overloading, "flooding", "mailbombing", "crashing", or denial of service attacks; (e) forge any TCP/IP packet header or any part of the header information in any e-mail or newsgroup posting; (f) use another party's account name or persona without authorization; or (g) take any action in order to obtain a Service to which you are not entitled.
You may not use the Service or Site to violate the privacy or confidentiality of others, including by transmitting, storing, displaying, distributing or otherwise making available others' private or confidential information (including without limitation their account names or personal data associated with their Service or Site account) without authorization.
Without limiting the foregoing prohibitions, you may not use the Service or Site for any illegal purpose or in violation of any laws (including without limitation data, privacy, consumer protection, and export control laws).
You may not use the Service in any situation where failure or fault of the Service could lead to death or serious bodily injury of any person, or to physical or environmental damage. For example, you may not use, or permit any other person to use, the Service in connection with aircraft or other modes of human mass transportation or nuclear or chemical facilities.
You are responsible for violations of this Policy by anyone using the Service or Site with your permission or using your account on an unauthorized basis. Your use of the Service or Site to assist another person in an activity that would violate this Policy if performed by you is a violation of this Policy. This Policy applies to anyone accessing or using the Service or the Site; however, each prohibition included in this Policy shall be interpreted to include, and apply to, any action directly or indirectly taken, authorized, facilitated, promoted, encouraged or permitted by a user of the Service or Site, even if such person did not themselves violate the prohibition.
Evolution Global reserves the right, but does not assume the obligation, to investigate any violation of this Policy or misuse of the Service or Site. Evolution Global has the right in its sole discretion to edit, refuse to post or remove any material submitted to or posted on the Service or the Site that Evolution Global finds to be in violation of this Policy. Evolution Global may report any activity that it suspects violates any law or regulation to appropriate law enforcement officials, regulators, or other appropriate third parties. Such reporting may include disclosing appropriate customer data. Evolution Global also may cooperate with appropriate law enforcement agencies, regulators, or other appropriate third parties to help with the investigation and prosecution of illegal conduct by providing network and systems information related to alleged violations of this Policy.
If you become aware of any violation of this Policy, you must immediately notify Evolution Global by email at [email protected] and provide Evolution Global with assistance, as requested, to stop or remedy the violation.
